Terms and Conditions
1. Equipment Rental Agreement
1.1. Rental Period: The rental period commences on the date of equipment pickup or delivery and concludes on the specified return date, adhering to Western Australian regulations regarding rental agreements.
1.2. Responsibility: The Renter ("Customer") acknowledges full responsibility for the Equipment during the rental period, including proper use, handling, and safekeeping.
1.3. Rental on Public Property: Rental of Equipment on public property is permissible only if the Customer can provide the required permits and permissions, in compliance with local regulations. PARTY BROS assumes no responsibility for obtaining these permits but encourages adherence to local laws.
2. Liability and Damages
2.1. Liability for Damages and Loss: PARTY BROS reserves the right to assess any damage or loss to the Equipment during the rental period. Any damage, as determined by PARTY BROS, will result in the Customer's deposit being withheld and may lead to additional charges to cover repair or replacement costs.
2.2. Weather-based Events and Power Outages: PARTY BROS cannot be held liable for weather-based events, including but not limited to heat, rain, lightning, strong wind, or power outages. Refunds in the event of these situations will be handled on a case-by-case basis.
2.3. DJ Liability: PARTY BROS is not liable for any issues arising from a DJ's use of the inflatable nightclub and associated equipment, in accordance with the relevant legal provisions.
2.4. Power Board and Extension Cord Usage: The use of PARTY BROS' power boards and extension cords is strictly limited to prevent overloading outlets, ensuring compliance with electrical safety standards.
2.5. Reticulation System Responsibility: It is the sole responsibility of the Customer to ensure that any automated reticulation systems (retic) are deactivated prior to the commencement of the booking period. Failure to do so may result in damage to PARTY BROS equipment or interference with the event setup. In such instances, the Customer shall bear full liability for any and all damages incurred, including but not limited to repair costs, equipment replacement, and any applicable cleaning fees. PARTY BROS reserves the right to withhold the Customer’s deposit and pursue further compensation where necessary.
3. Liability and Damages (Injury, Loss, or Damage)
3.1. Liability: PARTY BROS holds no liability for injury, damage, loss, or inconvenience resulting from Equipment use or malfunction. The Customer assumes all associated risks.
3.2. Damage Liability: The Customer is liable for any damage, loss, or theft of the Equipment during the rental period. PARTY BROS will assess repair or replacement costs, with the Customer agreeing to pay the specified amount within 14 days of notification, complying with contractual and legal obligations.
4. Equipment Use
4.1. Proper Use: The Customer agrees to utilize the Equipment solely for its intended purpose and in accordance with all applicable instructions, guidelines, and protocols, including those mandated by product safety regulations and consumer protection laws. The Customer shall not interfere with, handle, power on, or power off the Equipment unless expressly authorized to do so by duly designated personnel.
4.2. Safety: The Customer must use the Equipment safely and in compliance with all relevant laws and regulations.
5. Rental Fees and Payment
5.1. Rental Fees: The Customer agrees to prepay the specified rental fees as outlined in the rental agreement, adhering to pricing transparency regulations.
5.2. Security Deposit: A security deposit is mandatory and refundable upon satisfactory return of undamaged Equipment.
6. Reservation and Cancellation
6.1. Reservation: Equipment reservations depend on availability and should be made in advance to secure the desired Equipment for the rental period.
6.2. Cancellation: Cancellations made 30 days or more before the rental start date may be eligible for a refund at the discretion of PARTY BROS, and a cancellation fee may apply. Cancellations made between 30 and 14 days before the rental start date will be determined solely by PARTY BROS and will incur a cancellation fee. Cancellations made within 14 days of the rental start date will incur a cancellation fee.
Refund Policy
7.1. Refunds: Except as otherwise specified, all refunds for cancellations will be at the discretion of PARTY BROS, ensuring fairness and transparency in accordance with Western Australian consumer protection laws. All rentals are subject to a cancellation fee, which will be determined by PARTY BROS.
8. Cancellation by PARTY BROS
PARTY BROS reserves the right to cancel the rental agreement at any time, including in cases of adverse weather conditions, power outages, or any unforeseen circumstances. In such cases, a full or partial refund may be granted, solely at the discretion of PARTY BROS.
9. Governing Law
This Agreement is governed by and construed in accordance with the laws of Western Australia. Any disputes arising will be subject to the exclusive jurisdiction of the courts in Western Australia, ensuring legal clarity and compliance.
10. Changes to Terms and Conditions
PARTY BROS reserves the right to modify these Terms and Conditions and the Rental Agreement at any time. Updated terms will be available on the PARTY BROS website, and it is the Customer's responsibility to review them periodically.
11. Customer Responsibility and Acceptance of Terms
By proceeding with your Equipment rental, you confirm that you have read, understood, and agreed to these extensively detailed Terms and Conditions and the Rental Agreement in their entirety. Additionally, it is your responsibility to ensure you have read and understood these terms before making payment. A deposit is required, and bond refunds are subject to our determination. PARTY BROS may cancel at any time, including due to bad weather, with no guaranteed refunds. Your payment implies acceptance of these terms.
