Equipment Rental Agreement

These Terms and Conditions, along with the Rental Agreement, govern the rental of party equipment ("Equipment") from PARTY BROS Pty Ltd ("PARTY BROS"). By renting Equipment from PARTY BROS, you agree to adhere to these terms. Please carefully review this document before proceeding with your rental.

1. Equipment Rental Agreement

1.1. Rental Period: The rental period begins on the date of equipment pickup or delivery and ends on the specified return date.

1.2. Responsibility: The Renter ("Customer") acknowledges full responsibility for the Equipment during the rental period, including proper use, handling, and safekeeping.

1.3. Rental on Public Property: Rental of Equipment on public property is allowed only if the Customer can provide the required permits and permissions. PARTY BROS is not responsible for obtaining these permits.

2. Liability and Damages

2.1. Liability for Damages: PARTY BROS retains the right to assess any damage or loss to the Equipment during the rental period. Any damage, as determined by PARTY BROS, will result in the Customer's deposit being withheld and may lead to additional charges to cover repair or replacement costs.

2.2. Promotions and Giveaways: Any promotions, giveaways, or discounted hires remain subject to these Terms and Conditions. The Customer is fully liable, and the terms apply, irrespective of the nature of the hire or promotional offers.

2.3. Smoking and Equipment Tampering: Smoking is strictly prohibited in or around the inflatable nightclubs. Additionally, tampering with any equipment provided by PARTY BROS is not allowed.

3. Liability and Damages

3.1. Liability: PARTY BROS holds no liability for injury, damage, loss, or inconvenience resulting from Equipment use or malfunction. The Customer assumes all associated risks.

3.2. Damage Liability: The Customer is liable for any damage, loss, or theft of the Equipment during the rental period. PARTY BROS will assess repair or replacement costs, with the Customer agreeing to pay the specified amount within [number of days] of notification.

4. Equipment Use

4.1. Proper Use: The Customer commits to using the Equipment for its intended purpose and following provided instructions or guidelines.

4.2. Safety: The Customer must use the Equipment safely and in compliance with all relevant laws and regulations.

5. Rental Fees and Payment

5.1. Rental Fees: The Customer agrees to prepay the specified rental fees as outlined in the rental agreement.

5.2. Security Deposit: A security deposit is mandatory and refundable upon satisfactory return of undamaged Equipment.

6. Reservation and Cancellation

6.1. Reservation: Equipment reservations depend on availability and should be made in advance to secure the desired Equipment for the rental period.

6.2. Cancellation: Cancellations made [number of days] or more before the rental start date will receive a full refund. Cancellations within [number of days] of the rental start date may incur a cancellation fee. Refunds for cancellations made within 7 days of the scheduled rental date will be determined by PARTY BROS.

7. Refund Policy

7.1. Refunds: Except as otherwise specified, all refunds for cancellations made less than 7 days before the rental date will be at the discretion of PARTY BROS.

8. Cancellation by PARTY BROS

PARTY BROS reserves the right to cancel the rental agreement at any time, including in cases of adverse weather conditions or any unforeseen circumstances. In such cases, a full or partial refund may be granted, solely at the discretion of PARTY BROS.

9. Governing Law

This Agreement is governed by and construed in accordance with the laws of Western Australia. Any disputes arising will be subject to the exclusive jurisdiction of the courts in Western Australia.

10. Changes to Terms and Conditions

PARTY BROS reserves the right to modify these Terms and Conditions and the Rental Agreement at any time. Updated terms will be available on the PARTY BROS website, and it is the Customer's responsibility to review them periodically.

By proceeding with your Equipment rental, you confirm that you have read, understood, and agreed to these Terms and Conditions and the Rental Agreement in their entirety. Additionally, a deposit is required, and bond refunds are subject to our determination. PARTY BROS may cancel at any time, including due to bad weather, with no guaranteed refunds. Your payment implies acceptance of these terms.
